The Journal of Natural Resources and Environmental Law and the Eastern Mineral Law Foundation recognize the important role that "brownfields" laws play in addressing the problem of abandoned and under-used industrial sites. These sites often sit abandoned or under-used for years as state and federal officials pursue the parties actually responsible for the contamination. The tremendous costs which can arise under the strict liability scheme of CERCLA lead industrial developers to shun these otherwise usable lands while seeking out unused "greenfields" for new factories and other uses. Such wastefulness has lead to urban decay, the disappearance of greenspace from urban areas, and unnecessary urban sprawl. The 1998 JNREL Symposium on Brownfields will provide a forum for leading legal scholars and practitioners to discuss and debate existing brownfields laws and policies, with the goal of developing ways to address the diverse needs of the numerous parties involved in the complex process of brownfields redevelopment. | |
