Brownfield worries Wal-MartSHERRI C. GOODMAN Birmingham News (AL) May 21, 2006 Wal-Mart Stores Inc. doesn't want its name on the title for some of the property on the Eastwood Mall site, so Birmingham officials will consider a change Tuesday to an ordinance related to the sale of the land to the world's largest retailer. The property, owned by Wall Street investment firm Lehman Brothers, includes two parcels that have some environmental contamination, according to city and state officials. Under environmental laws, any company whose name has been on the title for a contaminated property could face liability risks related to the pollution, city attorney Jim Stanley said. The property is part of the Alabama Department of Environmental Management's voluntary cleanup program, said Larry Bryant, chief of ADEM's environmental services branch. Wal-Mart and Map Development, a Birmingham company that plans to build a shopping center on the site, jointly entered the application for the program with ADEM, so they are released from any legal liability tied to contamination, he said. ...
