State sues over cleanup costs at polluted school site Attorney general calls action over Elizabeth parcel the first of many BY RICK HEPP Newark Star-Ledger (NJ) December 12, 2006 In an offensive aimed at recouping millions of dollars it spent to clean contaminated land purchased for school construction, the state yesterday fired its first shot by suing a gasoline company over pollution at the site of Elizabeth Public School No. 30. The Attorney General's Office filed a lawsuit in Union County demanding that Getty Petroleum Marketing Inc. and Power Test Realty reimburse the state $885,000 for the remediation of hazardous substances found on the construction site. The lawsuit said the pollution was left behind by a Getty service station that had occupied part of the site. The Schools Construction Corp., a state authority that built the Elizabeth school on Pennsylvania Avenue, acquired the service station property and a neighboring parcel in October 2003 through eminent domain. Testing samples later showed both parcels were polluted with hazardous substances associated with the station, the lawsuit said. ...
