There is now way to pre-fund cleanup obligations and then assign that
obligation to a third party, which is guaranteed by a large life
insurance company.   This makes all cleanup stakeholders, especially
regulators, more confident with the financial foundation of the remedial
action plan, especially when there is a new property owner.

This is called an Environmental Structured Settlement.  The payment
streams can continue for 50 years, and it allows companies to manage
earnings and also avoid environmental disclosures.

The Environmental Structured Settlement, may be used in combination with
certain insurance policies and it can also be more competitive that
traditional insurance products.

In addition, funds may also be returned to the owner and/or the cleanup
contractor if the cleanup is performed under budget.
