To answer Peter's question, EPA does not have to list a site on the NPL to take emergency actions. The agency may implement removal actions at a site. There used to be a cap on the amount that could be spent but I forgot if that was lifted. There are numerous sites where EPA has taken initial actions and then filed cost recovery actions against PRPs. As part of the settlement, EPA would require the PRPs to complete the necessary remedial actions.
