Ruling worth $200M to $720M for Destiny USADevelopment's cleanup of "brownfields" qualifies for tax credits, judge says. By Rick Moriarty Syracuse Post-Standard (NY) June 14, 2008A judge in Syracuse ruled this week that a state Department of Environmental Conservation decision denying the Destiny USA development potentially hundreds of millions of dollars in "brownfield" cleanup tax credits was wrong. In a decision released Thursday, state Supreme Court Justice John Cherundolo said the DEC acted "arbitrarily" and "capriciously" last year when it denied Destiny USA's application for admission to the state's Brownfield Cleanup Program. He ordered the department to admit Destiny's land into the program. The DEC said Friday it was considering an appeal of the judge's decision. Destiny applauded the judge's ruling. ...
