AVX wants claims dropped Firm sees no value losses for landowner By David Wren Myrtle Beach Sun-News (SC) July 19, 2009Myrtle Beach-based AVX Corp. says toxic groundwater contamination that spread from its site to adjoining land has not created a financial hardship for a neighboring property owner, and the manufacturer wants a federal judge to dismiss damage claims against the company. Horry Land Co. - which owns the property across the street from AVX's 17th Avenue South headquarters - is fighting the manufacturer's attempt to obtain a summary judgment in the case, saying the pollution has cost the company at least $5.4 million. No court date has been scheduled to decide the matter.Meanwhile, two other pollution-related lawsuits filed against AVX have stalled while the manufacturer appeals a judge's March ruling that the cases should be heard in state court. AVX wants to combine those lawsuits - a class-action case filed on behalf of residents and another filed by JDS Development of Myrtle Beach Inc. - with the Horry Land case. All of the lawsuits - which were filed in late 2007 and early 2008 - allege that AVX contaminated groundwater at neighboring properties with an industrial degreaser called trichloroethylene, or TCE, a toxic chemical that has been linked to cancer and other health problems. ...
