Cranbury planning board sued over cleanup waivers

My Central Jersey
September 28, 2010

A brownfield redevelopment company filed a lawsuit Monday against the township Planning Board, alleging that members acted "arbitrarily and capriciously" when denying design waivers for a remediation and warehouse project on the former Unexcelled property.

Working with Viridian Partners, a Colorado-based company specializing in redeveloping contaminated sites, Cranbury Brick Yard Road, LLC, purchased the property in December 2006.

The 395-acre parcel on Brick Yard Road was once the site of a munitions plant that blew up in 1954, killing two workers and scattering explosive debris across the property.
