BM values TCE claims at $14 million Payments depend on severity of health, property value impact By TOM WILBER Binghamton Press & Sun-Bulletin (NY) October 11, 2015 After more than 10 years of waiting, plaintiffs seeking damages from exposure to toxic chemicals seeping from a former IBM site in Endicott were advised by their counsel last spring to settle for 40 percent of their claims, according to documents obtained by the Press & Sun-Bulletin. The settlement totaled $13.75 million for 440 plaintiffs suing IBM for personal injury and property damage from solvent pollution coming from the microelectronics site on North Street. A draft of the settlement proposal and an explanation of terms were outlined in documents obtained by the Press & Sun-Bulletin. Claimants suffering the most severe diseases associated with TCE exposure in homes that sat over the pollution and parties with substantial claims of devalued property and reduced incomes were offered the largest sums.
