States say Justice opinion not the final word on Air GuardBy Megan Scully Congress Daily August 15, 2005 A challenge from state officials to the Pentagon's proposed reorganization of the Air National Guard is not over, despite a Justice Department opinion that the units can be shuttered as part of the base-closure and realignment round. The 14-page opinion, released Friday, said the Defense Department can close or realign a National Guard base without the consent of the governor, contradicting one of the main arguments put forth by state lawmakers and Guard leaders. "It would have been a surprise if they ruled any differently," said Maj. Gen. Frank Vavala, Delaware's adjutant general and a vocal opponent of the Pentagon's recommendations. "I figured [the Justice Department] would side with the Pentagon on this." Vavala, who also serves as vice president of the Adjutants General Association of the United States, said the Guard will continue to meet with the independent commission reviewing the Pentagon's recommendations. ... The proposal, written by several adjutants general, asks the commission to accept only 11 of more than 50 recommendations affecting the Air Guard. It would allow every state to keep a flying mission and prevent the Air Force from creating so-called enclave units without planes. ...
