The military retains responsibility for cleaning up whatever mess it has made, but prevailing legal wisdom is that regulatory agencies cannot force DOD to spend what Congress chooses not to Appropriate. They may, however, be able to force some reallocation of appropriated cleanup budgets. The real world consequence of funding shortfalls is that regulators (and sometimes communities) often agree to less cleanup - sometimes accompanied by institutional controls on future use - to ensure that what is agreed upon will be funded. I'd like to hear other stories about how much budgets have been cut between the facility's development of requirements and the actual budget, and particularly plans to transfer BRAC responsibilities to FUDS.
