Sounds like the suit was filed under the wrong statute.When you sue the 
US, the authority to do so must be predicated on a waiver of sovereign 
immunity. While the FTCA is such a waiver, it is limited in scope. Why 
wasn't this suit brought under one of the environmental statutes, 
rather than the FTCA?
