SUBJECT:	Freedom of Information Act Request - Livens Projectile on 
Fort Ord, California 

Dear Ms. Christensen: 

	This is a request under the Freedom of Information Act (FOIA). I 
request a copy of all records relating to the discovery, investigation, and 
demolition of a Livens Projectile at Fort Ord, California in early or mid 
April 1999.  I believe such records are likely to include, without 
limitation, photographs, reports, incident reports, field logs and/or 
reports, and test data.

	In order to help to determine our status for purposes of determining 
the applicability of any fees, you should know that I am the director of the 
Fort Ord Toxics Project (FOTP), a non-profit corporation whose purposes 
include the communication of information regarding the environmental 
condition and cleanup of the former Fort Ord Army Base to members of the 
public.  FOTP accomplishes this purpose through publication of regular 
newsletters, fact-sheets, reports and by holding meetings with members of the 
public.  I am seeking these records to assist FOTP in its public education 
efforts, and not as part of any commercial venture.  I request a waiver of 
all fees for this request. Disclosure of the requested information to me is 
in the public interest because it is likely to contribute significantly to 
public understanding of the operations or activities of the government and is 
not primarily in my commercial interest

	I ask that my request receive expedited processing because 
information on the presence of potential chemical warfare munitions, such as 
the Livens Projectile, is urgently needed by the public due to the potential 
health risks associated with such munitions.  The possible health risks are 
underscored by the fact that the Army openly detonated the projectile on Fort 
Ord on about April 19, 1999.  The public needs to receive this information 
immediately so that the effected communities can evaluate the possible 
dangers posed by the Army's on-going activities of "clearing" munitions on 
the Base.
