The Management Guidance for the Defense Environmental Restoration Program (September, 2001), available at http://www.dtic.mil/envirodod/DERP_MGT_GUIDANCE_0901.pdf, contains what appears to be new language on the use of land use controls in Department of Defense cleanup programs. Most interesting, it requires the evaluation of alternatives allowing for unrestricted use at any project when land use controls are proposed" "21.5.6. For any evaluation of response alternatives commencing after October 31, 2000, where a use restriction will be imposed through the environmental restoration process, either as a stand-alone response alternative or as one component of a more complex action, Components [that is, the armed services and Defense agencies] shall ensure that the evaluation of response alternatives includes an analysis of an alternate with an use restriction, as well as an analysis at the level of detail appropriate to the size and scope of a response not requiring an use restriction (e.g., implementation of a response that allows unrestricted use). This will allow consideration of restricted and unrestricted use alternatives in selecting the response action." If this policy had been in place at Moffett Field this year, all stakeholders would have had better information with which to judge the Navy's proposed plan for Site 25, the wetlands area. I assume the new policy will enhance decision-making elsewhere, as well.
