Alaska FAIRBANKS DAILY NEWS-MINER Delta files suit to block Army facility By Victoria Naegele July 31, 2003 DELTA JUNCTION--An attorney for the city of Delta Junction filed a complaint for permanent injunction in U.S. District Court in Fairbanks Tuesday afternoon to halt U.S. Army Alaska's plan to construct a new high-tech training facility for the Stryker Brigade near Delta Junction. The case claims the Army failed to comply with the National Environmental Policy Act when it issued a finding of no significant impact, called a FONSI, on the proposed range expansion. There was no indication Tuesday when the case may be heard. "The Environmental Assessment, Appendix E, and the FONSI do not fairly, fully, or in good faith address the issues raised by Delta, and in some cases fail to address those issues at all," attorney James D. DeWitt of Guess & Rudd of Fairbanks wrote in the complaint. Delta Junction and its residents face permanent and irreparable injury if the range expansion proceeds, the city contends. DeWitt asks the judge to prevent the awarding of contracts in anticipation of the 2004 construction season. He also asked for a complete environmental impact statement--a longer, more involved process than the environmental assessment--or an amended environmental assessment to "fully address Delta's issues."
