Characteristic hazardous wastes are defined as wastes that are ignitable, corrosive, reactive, or toxic. A federal district court in California recently ruled, in part, that perchlorate is a hazardous waste under RCRA because it is ignitable.* *Castaic Lake Water Agency v. Whittaker Corp, 272 F. Supp. 2d 1053 (C.D. Cal. 2003). The conclusion that perchlorate is a hazardous waste was the first step in the court's analysis of whether perchlorate is a hazardous substance under CERCLA.
