Federal judge slaps down state Santa Susana Field Lab cleanup law By Teresa Rochester Ventura County Star (CA) April 27, 2011A federal judge found a landmark state law setting strict cleanup standards at a polluted former rocket engine and nuclear test site south of Simi Valley unconstitutional this week. Judge John F. Walter ruled the law, SB 990, unjustifiably singles out one site, the Santa Susana Field Laboratory, for "uniquely onerous treatment" with requirements not related to a legitimate state interest, violating equal protection and due process clauses of the 14th Amendment. Walter also found the state law, passed in 2007, violated the clause that essentially says federal law trumps state law. The arguments against the 3-year-old state law were laid out in a motion by Boeing Co., primary owner of the field lab site. ...
