Developer files $37 million claim with Fort Detrick over contamination claims

A developer that plans to build more than 700 houses near a Superfund site at Fort Detrick wants $37 million from the Army for its failure to stop contaminants from seeping onto adjacent land.

In an 11-page tort claim, Waverly View Investors LLC accuses the Army of devaluing its land and stalling or possibly thwarting its eventual development. That failure has led to threats and demands from both the Army and the U.S. Environmental Protection Agency to access the tract to allow a contractor to drill test wells. Thomas Lynch, of the Frederick office of the Baltimore law firm Miles & Stockbridge, filed the claim March 27 in Fort Detrick's Office of the Staff Judge Advocate.

Waverly View planned to develop about 92 acres next to Detrick's Area B later in 2013. The development is projected to have about 730 houses, according to the claim.
