Worker's comp claims being rejected TCE expose claims lead to rejections Workers had 1 year to file By FRANK JULIANO Connecticut Post December 13, 2004 - MILFORD - Construction workers exposed to toxic chemicals while building the Milford Power Co. plant in 1999 are seeing their workers' compensation claims rejected because they aren't getting sick fast enough. A blasting superintendent died this spring after battling a rare blood cancer that he believed was caused by trichloroethylene and benzene exposure at the site. A woman who worked as a laborer at the site is also seriously ill, said Ronald Nobili, president of Laborers International Local 665. "The statute says that a person has one year from the date of the incident to file a claim," Nobili said. "The problem is that this kind of cancer has a five-year latency period." Nobili, whose union had 40 workers at the site, and Glen Marshall, president of Carpenters Local 210, urged their members to file "preemptive" claims with the state Workers' Compensation Commission when the contamination became public in August 2003. ...
