Court upholds clean water standards for brownfields remediationAssociated Press Long Island Newsday February 28, 2006 TRENTON, N.J. -- The state Supreme Court let stand the state's clean-water standards for rehabilitated "brownfields" sites Tuesday, rejecting an assertion that they have undermined the cleanup of contaminated lands by being so strict. In a unanimous one-paragraph opinion, the Court upheld an Appellate Division ruling that said Department of Environmental Protection water purity standards for the sites do not violate the 1997 Brownfield Act, as the state Chamber of Commerce and Federal Pacific Electric Co. contended. The act was passed in a bid to spur cleanup and development of land that had been used for industrial purposes or was tainted by hazardous materials. In 2002, the DEP enacted regulations to enforce the act that said surface and groundwater at the remediated sites had to be _ eventually _ safe to drink. ...
