New York Department of Environmental Conservation Reissues Draft Revised 
Regulations and Proposed New Subpart 375-5

The Department has reissued the draft revised regulation for the 
Inactive Hazardous Waste Disposal Site Remedial Program (State Superfund 
Program), the Environmental Restoration Program (ERP), and the new 
Brownfield Cleanup Program (BCP). In addition, the Department has 
reorganized the regulation to separate the soil cleanup objective tables 
into a new Subpart 375-6, and included an additional description of 
their use in response to comments.

A new Subpart 375-5, the "Remediation Stipulation Program" is also being 
proposed. This proposed Subpart provides for an alternative remedial 
program, application to which is voluntary, which will facilitate the 
clean up and reuse of contaminated sites, thus stimulating economic 
revitalization, while ensuring the continued protection of public health 
and the environment. This program would address sites not eligible for 
the Brownfield Cleanup Program, or sites where a less structured program 
is sought.

The Department originally released the draft regulation on November 16, 
2005. Public meetings were held throughout the State in November and 
December 2005. The Department also held three public hearings in March 
2006. The Department has reissued the revised regulation and will allow 
for a second public comment period for draft Subparts 375-1 through 
375-4 and Subpart 375-6.

Public comments addressing changes since the November 2005 draft to 
Subparts 375-1 through 375-4 and Subpart 375-6 will be accepted until 
August 25, 2006.

Public comments addressing Subpart 375-5 will be accepted until 
September 5, 2006.
