Residents file lawsuit to stop Dunkin Donuts By MARIANNE IVERS Independent Pres (NJ) May 9, 2007CHATHAM -- A resident group called "Hedges & Main Advocacy Group" has filed a lawsuit against the Borough of Chatham, Planning Board and Shailja LLC, owner of the Dunkin Donut/Baskin Robbins (DD/BR) franchise that is in the process of turning the old Amoco gas station into a fast food shop. The lawsuit calls the board's Feb. 20 decision to allow the franchise in Chatham "arbitrary, capricious and unreasonable." The advocacy group, consisting of four borough residents: Rob Goldberg, Hans Dekker, Martin Selzer and Bernie Vella, filed the lawsuit on traffic and safety concern grounds. Other reasons behind the lawsuit are the group's claim that the board had not adequately provided for proof that the site has been sufficiently cleaned up prior to allowing any construction to start. The former Amoco station as well as the residential lot behind it is a registered contaminated site with the New Jersey Department of Environmental Protection (DEP). In February the board decided to waive "the letter of no further action" by the DEP that would indicate that the remediation process of the contaminated former gas station site has been completed. ...
