From: Judith Shaw <Judith.Shaw@dep.state.nj.us> DEPARTMENT of ENVIRONMENTAL PROTECTION SITE REMEDIATION PROGRAM Notice of Rule Proposal Notification of the Remediation of Contaminated Sites and Public Outreach Proposed New Rules and Amendments: N.J.A.C. 7:26C-10.4 and 7:26E-1.4, 1.11, 3.7, 4.1, 5.1, 8.2 Public Notice Take notice that the NJ Department of Environmental Protection is proposing new rules, and rule amendments. The Department is proposing to amend the Technical Rules to include mandatory notification requirements for the person conducting the remediation of a contaminated site. Notification requirements may be satisfied by posting a sign or sending notification letters to local officials and the public including, the owners and tenants of properties located within 200 feet of the site boundary. The amendments require the person conducting the remediation to identify sensitive populations located within 200 feet of the site. The Department will require additional public outreach when local citizens or officials demonstrate substantial public interest by submitting a petition to the Department, or when contamination migrates past the boundary of the site. Additional public notice will be required when the person conducting the remediation proposes to bring contaminated material onto the site in excess of the amount that is needed to complete the remediation. The proposal was published in the New Jersey Register dated August 6, 2007.
