Developer to take case to State's Highest Court By Linda Quinlan Irondequoit Post (NY) May 1, 2009 Irondequoit, N.Y. -There may yet be some hope for a major development project in northwest Irondequoit. A state appellate court will allow the Court of Appeals - New York's highest court - to hear an appeal of the lower court's ruling that denied environmental cleanup money for a site eyed for a project called Lighthouse Pointe. The developer of Lighthouse Pointe, Charles Morgan of Brighton, long has said he can't move forward with the 47-acre project he'd like to build on the banks of the Genesee River - just north of the O'Rorke Bridge - without the tax breaks the brownfield program would bring. Much of the land is on a former landfill, so it requires cleanup. The state Department of Environmental Conservation previously ruled the property did not qualify for cleanup money, precipitating the initial lawsuit several years ago. ....
