DEC wants state's highest court to review Destiny USA brownfield tax
credits dispute
by Rick Moriarty Syracuse Post-Standard (NY) August 11, 2009,The state Department of Environmental Conservation is not giving up in its fight with developer Robert Congel over tens of millions of dollars worth of state tax credits for Destiny USA, his expansion of the Carousel Center mall. The department is seeking to appeal to the state's highest court a decision by two lower courts that overturned the department's denial of Destiny USA Development LLC's application for admission into the state's Brownfield Cleanup Program. The department filed a motion with the Appellate Division of state Supreme Court in Rochester for permission to appeal to the Court of Appeals in Albany. ...
