Subject: | [CPEO-BIF] New EPA Guidance on liability at leased renewable energy sites |
On December 5th, two U.S. EPA offices jointly issued "Revised
Enforcement Guidance Regarding the Treatment of Tenants Under the
CERCLA Bona Fide Prospective Purchaser Provision" and Model Comfort/
Status Letters for Lessees at Renewable Energy Projects. This updated
enforcement discretion guidance addresses the treatment of tenants
concerned about CERCLA liability at contaminated and potentially
contaminated sites in an effort to support redevelopment
opportunities nationwide.
