MTCA: Washington State Amends Its Cleanup Law By Meline MacCurdy Marten Law December 1, 2013Earlier this year, Washington State enacted the most comprehensive rewrite of its state cleanup law in a decade. The amendments to the Model Toxics Control Act (MTCA), Substitute Senate Bill (SSB) 5296, are aimed at expediting and streamlining routine cleanups, incentivizing and assisting regional development efforts in brownfield areas, overhauling the allocation and use of grant funding for certain existing and new programs, and improving government tracking and accountability of progress under the MTCA program. Achieving on-the-ground change to the state program is dependent on regulatory developments by the Washington State Department of Ecology (Ecology), action by local governments, and the availability of funding to finance the variety of new programs contemplated by the bill. This article provides an overview of the key components of the MTCA amendments and highlights issues of particular relevance to stakeholders as the implementation of the amendments takes shape. ...
