Millsboro residents take chicken plant decision to court By Sarah Lake Rayne Sussex Countian (DE) December 11. 2013 A local environmental advocacy group has filed an appeal to overturn the Sussex County Board of Adjustment's approval of a permit for a proposed chicken processing plant in Dagsboro, just next to several Millsboro communities. Protecting Our Indian River filed the appeal with Sussex County Superior Court on Dec. 4, citing "the BOA's lack of jurisdiction under Delaware state law to issue the permit, the fact that the BOA did not base its decision on substantial evidence in the record showing the development will be protective of the public's health and safety, and the BOA's violation of public notice and hearing requirements in issuing the permit," according to a news release. The permit application was submitted earlier this year by poultry firm Allen Harim Foods for the Pinnacle Foods-owned site and requests a special use exception for a potentially hazardous use.
