Judge denies Roxbury's bid to test soil from DEP's wells at landfill

MORRISTOWN - Roxbury Township lost a round today in its dispute with the state over how best to clean up the closed Fennimore Landfill.

A Superior Court judge refused to issue an emergency order sought by the township that would have allowed it to test soil from 21 new wells the Department of Environmental Protection is about to dig at the site.

The landfill, closed since 1979, reopened in December 2011 with plans to cap it and install a solar generating facility there. But in June 2013, the DEP took over the landfill after receiving thousands of complaints about odors and health problems linked to the hydrogen sulfide.
