Guidance For Institutional Controls at Hazardous Waste Cleanups 

Region 5 guidelines for implementing institutional controls, as part of
cleanups at hazardous waste facilities, were issued in March 2000.
Institutional controls are legal mechanisms designed to control exposures
to chemicals in environmental media, including soil and groundwater.  These
controls are usually part of a facility's cleanup program where
contamination remaining in place causes the use of the property to be
restricted.  These guidelines will help EPA project managers and regulated
facilities determine if institutional controls are an appropriate and
reliable part of a facility's cleanup program.  

The guidance:  

*  encourages project managers to evaluate the appropriateness of
institutional controls early in the cleanup process;

*  lists specific criteria, including the future use of the property, that
project managers should consider when evaluating a facility's request to
restrict the use of a property;

*  stresses the importance of public input; and,

*  highlights the importance EPA's ability to enforce the legal mechanism
establishing the institutional control to ensure its reliability.
