********************************************************** Government joins in appeal of ruling blocking tribal casino in Kansas Date: 04/14/00 22:15 The U.S. government has joined an appeal of a recent federal court ruling that blocked plans by the Miami Tribe of Oklahoma to build a casino in Miami County, Kan. In a notice filed late Thursday, Jackie N. Williams, U.S. Attorney for Kansas, said U.S. District Court Judge G. Thomas Van Bebber had erred in February when he barred the Department of the Interior from proceeding toward licensing the casino until legal questions about the land and the tribe's sovereign jurisdiction over it were resolved in court. After years of litigation against the state and others, the tribe last year won various federal agency rulings declaring the site eligible for casino gambling under the 1988 Indian Gaming Regulatory Act -- even though the tribe formally relinquished the land more than 120 years ago when it migrated to Oklahoma. The casino would be built on 35 acres near La Cygne Lake, about 45 miles southwest of Kansas City. Publicly traded Butler National Corp. of Olathe has been approved by federal gaming regulators as the tribe's casino management company. The tribe earlier announced its intention to appeal.
