I couldn't agree more with Lenny's assessment and would venture to guess 
this is one of the many reasons DoD is pushing for environmental 
exemptions due to losing these battles in court, yes?

The bottom line for the military is do the cleanup for the safety and
health of the environment and public, congress to appropriate the money 
for such and the third party lawsuits will not be necessary.
