DOD Submits "RRPI2"

The Defense Department has submitted to Congress, as Section 316 of its
proposed National Defense Authorization Act for Fiscal Year 2004, a new
version of the Readiness and Range Preservation Initiative. The new
section contains the elements of last year's initiative that Congress
chose not to enact, with some potentially significant changes in
wording. The proposed provisions address:

1. The designation of critical habitat under the Endangered Species Act.

2. Military conformity with State Implementation Plans under the Clean
Air Act.

3. Definitions of munitions wastes and releases under the Resource
Conservation and Recovery Act (RCRA) and the Comprehensive Environmental
Response, Compensation, and Liability Act (CERCLA).

4. The definition of harassment under the Marine Mammal Protection Act.
