Governments would lose under takings legislation By JEREMY HSIEH Beaufort Gazette (SC) February 16, 2007A state study committee heard about three hours of testimony in Columbia on Thursday -- mostly in opposition -- to legislation that would protect landowners' rights at the expense of local governments' coffers. Sixteen of about 20 speakers, including representatives of Marine Corps Air Station Beaufort, the Beaufort Regional Chamber of Commerce and the Town of Hilton Head Island, argued against so-called regulatory takings legislation, said Paula Benson, staff counsel for the state Senate's Judiciary Committee. As outlined in a House bill introduced last year, landowners would be paid for property value losses caused by county or municipal actions. Advocates say the takings legislation protects property rights; opponents say it would limit land planning and the ability to enforce environmental rules. ...
