Aquifer Group Threatens Suit to Enforce Bullis Agreement Files 'sixty day intent' letter By Jim Forsyth WOAI Radio News (San Antonia, TX) June 29, 2008As negotiations between the U.S. Fish and Wildlife Service and INTCO Dominion Partnership continue over the fate of development southwest of Camp Bullis, several environmental groups have filed a notice of intent to sue INTCO over the continued destruction of golden-cheeked warbler habitat if the negotiations do not result in a satisfactory solution, 1200 WOAI news has learned. "This sixty day notice letter puts INTCO Dominion Partnership on notice that the parties intend to sue under the provisions of the Endangered Species Act," said Enrique Valdivia, President of Aquifer Guardians in Urban Areas, an environmental watchdog group. AGUA sued INTCO two weeks ago to stop clear cutting of trees and underbrush to build a road along the Camp Bullis fence line, but that suit was withdrawn when Fish and Wildlife and INTCO agreed to negotiations to work out an agreement. INTCO attorney Alan Glen said the lawsuit would have been dismissed, because the 'citizen suit' provision of the ESA requires a 60 day notice be provided before lawsuits are filed. ...
