Law shielding private property near Luke upheld Judge: State's zoning powers near military bases top private-property rights by David Madrid The Arizona Republic Feb. 11, 2009A Superior Court judge has ruled in the state's favor and against Maricopa County, upholding a law that prevents residential encroachment on Luke Air Force Base and its Auxiliary Field 1. Base advocates called the law crucial to the survival of Luke and the rest of the state's military bases. Judge Edward Burke granted the state a preliminary injunction late Monday. It requires the county to adopt a general plan and zoning regulations compatible with the high-noise and accident-potential zones of Luke, "Aux 1" northwest of the Glendale base and the Gila Bend Air Force Auxiliary Field. ...
