This is a good example of the United States Army shutting down public participation through unauthorized application of public participation limitations. That the Army did so through its "revitalization" partner, the local municipality that is the recipient of contaminated federal property, is of no moment. This is the creep of the armed forces participating in civilian lawmaking through property transfers and the application of the its lead agency status under federal environmental law. Executive Order 12580 must be rescinded so that US EPA is lead agency at all Superfund sites, including those at federal facilities. Otherwise the Armed Forces will continue to find ways to buy off local officials with favorable property transfers and shut down public participation as was done here.

Activist arrested for disorderly conduct at FMERA meeting
Board passes 2012 fiscal plan, expects $31M from land sale in first year

TINTON FALLS - Less than 30 seconds into his public comment at the
Dec. 21 meeting of the Fort Monmouth Economic Revitalization
Authority (FMERA), an outspoken activist about environmental and
transparency issues at the fort was arrested for disorderly conduct
for disrupting the meeting.

Tom Mahedy, from Wall Township, regularly attends FMERA meetings and
is an active member of the FMERA Environmental StaffAdvisory Committee.

"There is corruption and conspiracy all over the FMERA board," Mahedy
said before a Tinton Falls Police Department officer began escorting
him out of the room.

FMERA Chairman James Gorman called for the police officer after
telling Mahedy to stay on topic during the evening's first public
comment portion, which is reserved for agenda items only.
