Curious if anyone recalls a situation where a state agency or local government failed to conduct an ESA (or conducted too cursory of a review) as a result of some project or partnering on some project (e.g., housing, highway, public building etc.,), and then ended up footing a part of the clean up cost under Superfund or some other form of environmental liability ? Looking for some good examples. Thanks in advance.....
