(from Peter Meyer <pbmeyer@louisville.edu>) Also worth noting is that UST "pay for performance" pilot efforts seem to show they've hit on major cost/time savers -- and there is some interest in using that approach for brownfields as well -- at least on the part of some state-level parties. The logic is that the monies provided cannot be used for 'time and materials" billing by engineering firms, but for attainment of specific performance stages. This means the engineers have an incentive to get done fast -- and there is no payment for "cost overruns," unless specific standards for determination of their cause and attribution of responsibility are negotiated in advance of work initiation. Time and cost can both be halved, as I understand it. ... this does not solve the exclusion problem, but is a logical approach to facilitating brownfields reclamation, and local use of such contracts can be enforced if their use is a requirement of provisions in state and/or federal grants or loans to assessments and mitigations.
