Lighthouse Pointe project's ruling overturned Alan Morrell Rochester Democrat and Chronicle (NY) February 7, 2009IRONDEQUOIT - A proposed $200 million residential and retail complex along the Genesee River near Lake Ontario is in peril because of a court ruling issued Friday. The Appellate Division of the state Supreme Court overturned an earlier court ruling that would have allowed the proposed 47-acre Lighthouse Pointe development to be part of the state Brownfields Cleanup Program. That program provides tax credits and other incentives for re-use of contaminated sites. "It's definitely in jeopardy," said Alan Knauf, a lawyer for project developer Charles Morgan, who said he would appeal the latest ruling with the state Court of Appeals. "If we don't win this case, (Lighthouse Pointe) is not going to happen. The state will have succeeded in preventing development at the Port of Rochester, at a toxic waste site, and it's just going to sit there." ...
