Lawsuit against GE to continue Justin Murphy Auburn Citizen (NY) July 12, 2011The state Appellate Division in Rochester has upheld a group of Aurelius residents’ lawsuit against General Electric over years of water contamination, setting the stage for a trial this winter. The residents sued GE in 2001, seeking damages and medical monitoring payments because the GE-Powerex factory on Genesee Street Road had contaminated their drinking water wells for many years with carcinogenic chemicals, including trichloroethylene or TCE. The residents also alleged that the company sought to cover up the problem when it first discovered it in the late 1980s. The company asked Cayuga County Supreme Court Judge Thomas Leone to dismiss the case last October, saying the residents had shown no health problems and were unlikely to develop any. Leone dismissed that claim, and GE appealed. ...
