Challenge to Allen Harim pollution plan in court

The Inland Bays Foundation and a Millsboro-area citizens' group argued a state-approved cleanup plan for a rusting pickle plant Allen Harim Foods wants to make into a poultry processing site cannot discern if pollutants are leaking away from the property.

The foundation and Protecting Our Indian River have sued to overturn a May 2014 decision by the state Environmental Appeals Board that favored Allen Harim. The Board opinion affirmed the Department of Natural Resources and Environmental Control's decision to sign off on Allen Harim's brownfield remediation plan for the property, formerly operated by Pinnacle Foods to manufacture Vlasic-brand pickles.

The plan calls for onsite monitoring of water and soil, with wells and soil tests inside the property's borders, for signs known pollutants might be spreading to residential neighborhoods.

The pollution control plan, authored by Allen Harim in 2013 and approved by DNREC, doesn't call for monitoring wells located off the industrial property. And it doesn't make the company mitigate water or soil pollution already known to be present, or test for signs of increasing soil pollution.
