The Defense Department has issued a draft outline of its plans for the development of its rule for "Clearance of Closing Ranges," designed to govern the removal of waste munitions from and restrict access to former impact ranges. This is the rule referenced in the proposed EPA Munitions Rule. When DOD completes its rulemaking, EPA proposes to sunset its own provisions dealing with closed/closing ranges. DoD Rule for Clearance of Closing Ranges Notice to Commence rulemaking - Prior to 31 January 1996 Rulemaking will involve the states and public Rulemaking will be conducted in consultation with EPA Will be fully protective of public health and the environment Will contain a significant role for both the interested public and affected states in site specific remedy selection and implementation process Use existing DoD statutory authorities (10 USC 172 and 10 USC 2701) Will be safety-based Will have unexploded ordnance clearance standards (both risk-based and default) (Chapter 12, DoD 6055.9-STD) Clearance level will be determined by end-use Will have access/change of use restrictions Will be promulgated NLT 31 October 1996 Army is DoD lead agency for rulemaking Will discuss at the 1-2 February 1996 meeting of the WGA Munitions Workgroup Point of Contact: Colonel Dick Wright, Defense Explosives Safety Board | |
