Subject: | [CPEO-MEF] Lassen County orders a halt to OB/OD at Sierra Army Depot |
Opponents of open burning/open detonation as a method of munitions demilitarization at the Sierra Army Depot appear to have won a major victory this month. The Lassen County Air Pollution Control District has ruled, "any continued open burning and/or open detonation activities at Sierra Army Depot will constitute violation of District rules and permit conditions and will result in enforcement action ..." Here's the text of the letter: August 11, 2001 Mr. Paul Fulkerson, P.E. Director of Public Works Sierra Army Depot SIOSI-PWV, Bldg. 79 Herlong, CA 96113 Dear Mr. Fulkerson: This letter shall serve as notice that pursuant to Lassen County Air Pollution Control District Rule 4:7 and 4:8 and Title V Operating Permit # 18-98-TV-1, page 31, Sierra Army Depot has not demonstrated any bases for a 4:9 exemption from open burning and open detonation restrictions. Therefore, notice is also given that any continued open burning and/or open detonation activities at Sierra Army Depot will constitute violation of District rules and permit conditions and will result in enforcement action by the District including, but not limited to, abatement proceedings, in accordance with District Rule 1:5. Sierra Army Depot is advised that pursuant to District Regulation 5, it may file a petition for variance with the District Hearing Board.
