Court to Take Agent Orange Case Supreme Court to Take Agent Orange Case, Grants Petition From Chemical Companies The Associated Press W A S H I N G T O N, Nov. 4 ? When Vietnam War veterans Daniel Stephenson and Joe Isaacson learned they had cancer, they tried to collect from a fund for those exposed to Agent Orange only to find out they were too late. So the two men sued, drawing charges of foul play from chemical companies that created the $180 million fund after being promised they wouldn't have to pay out any more money. The 2nd Circuit U.S. Court of Appeals said the veterans could sue, but the Supreme Court on Monday granted a petition from the chemical companies and agreed to decide the case. At issue is whether people should be allowed to bypass previous class action settlements.
