For the cities, the key issue is redevelopment, but that does not contradict the health issue. If the sites get redeveloped, they will be cleaned up and therefore be far less of a health threat. It does not seem unreasonable to require the owner's permission to publish or list the site somewhere. The EPA has been sued three times on this issue, and it won all three times. Therefore, ultimate liability is unlikely, but it would definitely be prudent to get the owner's permission as well as a release.
