I do not know the intent of Congress, but according to section 101(33) of CERCLA, which S. 350 amends, the term "pollutant or contaminant" specifically excludes petroleum, including crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under CERCLA section 101(14).
