Dear Colleagues, Thanks for your prompt help on the petroleum question in regard to S.350. Below is another question, posed by my City of Tucson counterpart, Sal Morales. Do you have insight on this one? Ren, the proposed legislation has the normal exclusions listed in Sec. 101 (a) (39)(B),(i) thru (ix). Does item (ii) "a facility that is listed on the NPL or proposed for listing" include all the state WQARF [state Superfund] sites? Or would a WQARF site be excluded from brownfields designation under item (iv)? I'd appreciate any guidance.
