I do not know for sure but I believe that phrase simply parallels the 
language in section 104(a)(1) of CERCLA authorizing the President to take
response actions for releases of polluntants or contaminants presenting an
imminent and substantial endangerment. One might argue that petroleum could
fit into that category even if the definition of hazardous substances
excludes petroleum. Of course, the problem with CERCLA is that sections 106
and 107 are limited to hazardous substances.

I understand that an issue of concern to the commerce committe is the
finality of cleanup issue.
