Back on courseJudge dismisses lawsuit against Harbor Shores golf course; plaintiffs contend swap of parkland for river frontage is bad for environment By EVAN GOODENOW Herald-Palladium (MI) January 19, 2010BENTON HARBOR - Harbor Shores developers have chipped out of a legal sand trap with the dismissal of a lawsuit seeking to block construction of three holes of the project's golf course at Jean Klock Park. ...Plaintiffs contended the swap of the approximately 21-acre golf course land for 38 acres along the Paw Paw and St. Joseph rivers was a bad deal because the 38 acres are contaminated with arsenic and heavy metals that could leach into the waterways. The plaintiffs asserted the environmental impact wasn't fully considered. However, Bell's 57-page decision found the National Parks Service's analysis of the U.S. Army Corps of Engineers and Michigan Department of Environmental Quality environmental studies were comprehensive and labeled the plaintiff's contention "unsupported speculation." ...
